基金与基金公司

证券投资基金（一般称基金），是基金公司发行的的产品。在与基金相关发行、管理、、注册登记、销售等环节中，与基金管理人（即基金公司）相关的包括基金的发行和管理、登记注册、部分销售业务（直销）。这里要着重说明的是，基金财产独立于基金管理人固有财产。也就是说，一方面，基金公司不得将基金财产归入其固有财产。在基金公司破产清算或追债的时候，基金不在此列；另一方面，投资者购买基金的行为不属于购买基金公司的资产。

基金管理公司是指依据有关法律法规设立的对基金的募集、基金份额的和赎回、基金财产的投资、收益分配等基金运作活动进行管理的公司。证券投资基金的依法募集由基金管理人承担。基金管理人由依法设立的基金管理公司担任。担任基金管理人应当经国务院证券监督管理机构核准。按设立方式划分，按投资对象划分 Funds and Funds Corporation
